Resolution 25-03: City of Kramer License and Permit Fees

Whereas the City of Kramer recognizes that North Dakota Century Code (NDCC) 53-06.1-03 permits a governing body of the city or county to charge a fee for the application of a gaming site authorization within said city.

Whereas the City of Kramer recognizes that NDCC section 5-02-01.1. permits a governing body of the city or county to charge a fee for the application of a special event license involving the sale and/or consumption of alcohol at a location different than an approved premises.

Whereas the City of Kramer recognizes the city may recover the costs incurred in providing copies of public records under the Open Records and Meetings law.

Be it resolved the City of Kramer shall establish a fee of twenty-five dollars ($25.00) for gaming site authorizations and Special Event Permits described herein. Furthermore, the City of Kramer shall require payment of the fee prior to the release of the SFN17996 to the gaming authority or release of the Special Event Permit to the requestor. 

Be it resolved the City of Kramer shall enact Section 44-04-18(2), North Dakota Century Code which provides that a public entity may charge up to twenty-five cents per impression of a paper copy. As used in this section, “paper copy” means a one-sided or two-sided duplicated copy of a size not more than eight and one-half by fourteen inches. For any copy of a record that is not a paper copy as defined in this section, the public entity may charge a reasonable fee for making the copy. As used in this section, “reasonable fee” means the actual cost to the public entity of making the copy, including labor, materials, and equipment. The entity may charge for the actual cost of postage to mail a copy of a record. An entity may require payment before locating, redacting, making, or mailing the copy. The law also allows a public entity to charge $.25 per page for a printed copy of an electronic record if it is necessity to print the file.  

Be it resolved the City of Kramer decrees this resolution negates and replaces all previous city ordinance and resolutions, and any other written or spoken agreements addressing permit fees signed by the City of Kramer.
